These Terms govern your access to and use of Miss Phoenicia, including the website, contestant submission system, public voting system, images, content, and related features.

1. Acceptance of Terms

By accessing or using the website, signing in with X, submitting a portrait, or voting, you agree to these Terms. If you do not agree, do not use the website.

2. About Miss Phoenicia

Miss Phoenicia is an online cultural pageant and public voting platform featuring AI-generated Phoenician-inspired portraits. Contestants may submit portraits for review, and the public may vote for approved contestants using X authentication.

Miss Phoenicia is not affiliated with, endorsed by, sponsored by, or officially connected to X Corp. X is used only for authentication and user identity verification.

3. Eligibility

To use the website, you must be able to enter into a binding agreement under applicable law. Contestant submissions should only be made by individuals who are at least 18 years old, unless official pageant rules expressly allow younger participants with verified parent or guardian consent.

4. X Login Requirement

Certain features require you to sign in using your X account. By signing in with X, you authorize us to receive limited X account information, such as your X user ID, username/handle, display name, and related authentication information, for the purposes described in our Privacy Policy.

We use X authentication to verify identity, prevent duplicate voting, prevent duplicate contestant submissions, and protect the integrity of the pageant.

5. Contestant Submission Rules

Each authenticated X account may submit only one contestant image. Submissions must include all required information, including contestant name, X handle, region, character name, portrait image, and concept statement.

By submitting a portrait, you represent and warrant that the submission is your own work or that you have all required rights and permissions; that you have the right to upload, display, and publicly share the image; that the portrait does not infringe copyrights, trademarks, publicity rights, privacy rights, or other rights; and that the submission does not contain unlawful, abusive, hateful, threatening, defamatory, sexually explicit, exploitative, malicious, or otherwise inappropriate content.

6. Approval Before Public Display

Submitting a portrait does not guarantee that it will appear publicly. All contestant submissions may be reviewed by an administrator or moderator before being added to the public contestant browser. Only approved submissions will appear publicly.

We may reject, remove, edit display formatting, hide, or disqualify submissions at our discretion.

7. License to Use Submitted Content

You keep ownership of your submitted content. However, by submitting content to Miss Phoenicia, you grant us a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to host, store, reproduce, display, publish, crop, resize, convert, distribute, promote, and otherwise use the submission in connection with the Miss Phoenicia website, public contestant galleries, voting displays, winner announcements, social media promotion, pageant-related marketing, archives, and recaps.

8. Voting Rules

Voting may require X authentication. Each authenticated X account may cast only one vote during the voting period. Before a vote is recorded, the website may ask you to confirm your choice. Once confirmed, your vote is final and cannot be changed.

Votes may be rejected, removed, or disqualified if we believe they involve duplicate accounts, bots, automation, vote buying, manipulation, fraud, harassment, technical abuse, violation of these Terms, violation of X rules, or violation of applicable law.

10. Prohibited Conduct

You agree not to submit false or unauthorized information, impersonate another person, submit content without rights or permission, attempt to vote more than once, use bots or automation, interfere with website security, bypass authentication or moderation controls, upload harmful files, scrape or misuse contestant information, harass or threaten others, or use the website for unlawful purposes.

11. AI-Generated Content Disclaimer

Miss Phoenicia may include AI-generated artwork and concept imagery. We do not guarantee that AI-generated content is unique, historically accurate, non-infringing, or free from similarity to existing works. Submitters are responsible for reviewing their content and ensuring they have the right to submit and display it.

12. Intellectual Property

The Miss Phoenicia name, branding, design, website layout, logos, pageant structure, text, graphics, and other original materials are owned by us or our licensors, except for content submitted by users or third-party materials used with permission.

13. Third-Party Services

The website may use or link to third-party services, including X, hosting providers, analytics tools, email services, and other infrastructure providers. We are not responsible for third-party services, websites, policies, content, or actions.

14. No Guarantee of Availability

We try to keep the website available and functioning, but we do not guarantee uninterrupted, secure, or error-free operation.

15. Changes to the Website or Pageant

We may modify, suspend, or discontinue any part of the website or pageant at any time, including contestant submission features, voting features, rankings, deadlines, display formats, eligibility rules, approval processes, or public results.

16. Disclaimers

The website and all content are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and security.

17. Limitation of Liability

To the maximum extent permitted by law, Miss Phoenicia, its owners, administrators, partners, service providers, and affiliates will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including loss of data, loss of goodwill, lost opportunities, or website downtime. Our total liability for any claim related to the website or pageant will not exceed $100 or the amount you paid directly to us, if any, to use the website.

18. Indemnification

You agree to defend, indemnify, and hold harmless Miss Phoenicia, its owners, administrators, partners, service providers, and affiliates from any claims, damages, losses, liabilities, costs, or expenses arising from your use of the website, your submitted content, your violation of these Terms, your violation of another person’s rights, your violation of law, or your attempt to manipulate submissions or voting.

19. Termination

We may suspend, restrict, or terminate your access to the website at any time if we believe you violated these Terms, created risk for the website, harmed another user, manipulated voting, or acted unlawfully.

20. Governing Law

These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict-of-law principles, unless another jurisdiction is required by applicable law. Any dispute will be handled in the state or federal courts located in Michigan, unless applicable law requires otherwise.
